This website is the official website of the member companies of Genesis Biopartner and has been created in order to ensure greater transparency and a better understanding of the activities carried out by the companies of the Genesis Group in Romania.

2. Purpose of the Privacy Policy and Users Concerned

This “Privacy Policy” aims to inform visitors and users of the Website about the data processed when using the Website, the purposes for which this data is used, the rights of the persons concerned, and other aspects of the protection of this data, in accordance with (EU) Regulation 2016/679 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (GDPR), but also in accordance with applicable national legislation on data protection (e.g. Law 506/2004 on the processing of personal data and the protection of privacy in the electronic communications sector).

By accessing and using the Genesis Biopartner website, information about how you use the website may be collected automatically, including your IP address, browser type, pages visited, and more. This information is used for analytical purposes and to improve the user experience.

We, the Genesis Companies in Romania, may modify the Privacy Policy at any time, in particular to comply with any editorial or technical regulatory changes. The information is published on the Website, in the Privacy Policy section.
 

3. Description of processing

a) Purposes of processing.

Operators process personal data collected through the Website for the following purposes:

  • to allow Users to access the functions and information provided through the Website,
  • to ensure the security of the Website,
  • to defend our rights in the event of legal action,
  • to carry out and manage internal audit and control operations,
  • to contact you and send you a personalized, detailed offer customized to your needs, following a request submitted through our contact form;
  • to contact you and send you a special newsletter with news about our activities and projects. If you clicked on the “Subscribe to Newsletter” button, entered your email address, and checked “I have read the GDPR policy and agree to save the planet (within legal limits),” or interacted directly with our pop-up window for collecting email addresses for sending the newsletter, we will process and use your email address to send you our newsletter periodically. Subscription to the newsletter is voluntary and the processing of the associated data takes place on the basis of your consent, as defined in art. 6 para. 1 (a) of the GDPR. You have the right and the possibility to be deleted from the newsletter distribution list at any time. Simply send an email to marketing@genesisbiopartner.ro. You also have the option of clicking on the unsubscribe link in the newsletter you receive.

b) What categories of data are processed? 


Data collected directly from you:

  • Identification and contact data: this refers to the mandatory data that Users enter by filling in the contact forms, for example: first name, last name, telephone number, address, email address.
  • Data provided voluntarily by the User: This refers to personal data that Users provide to the Operator voluntarily by filling in the text boxes provided for this purpose in the contact form(s), i.e. the "Message". Operators strongly recommend that Users avoid providing any additional personal data through these text boxes and, in any case, only provide information that is strictly necessary to process the User's request (hereinafter referred to as "Published Data").
  • Data related to professional experience and education, as well as personal data for the purpose of communicating with the Genesis Biopartner team: this refers to the User's CV, education, contact details, and/or introductory message. Such Data is provided by the User when applying for a professional or internship opportunity at a Genesis company in Romania (Careers section).
  • Data related to the IP address and type of device you use when visiting the Website.
  • Mandatory fields that must be completed in the contact form(s) and/or when submitting an application are marked with an asterisk. If you do not fill in the mandatory fields, we will not be able to respond to your request.


Data collected indirectly from you:

  • Data obtained from third parties: for example, if you are the representative of a legal entity, we may check public information from the Trade Register to obtain more information about your capacity as representative or to validate the data you have sent to us.
  • Inferred data: we may check our internal database to see if there is any connection between your message and combine the information to send our response to you.

Please note that we do not check or combine information provided by social media platforms (e.g., Facebook, Instagram, etc.) to formulate a response to you. When you apply for a job or internship opportunity with a Genesis company in Romania, we may check professional social media platforms, such as LinkedIn.

All of this data will be referred to collectively as "Data". In addition to the Data mentioned above, we also process data collected through cookies. For these categories of data, purposes, and retention periods, we recommend that you consult the Cookie Policy on the website www.genesisbiopartner.ro.

c) What is the legal basis for processing User Data?

Data processing is lawful only if it is carried out on one of the legal bases defined by the GDPR. The legal basis for data processing carried out in connection with the use of the Website is as follows:

  • when you submit a complaint via the Contact section - performance of the contract (art 6.1 lit. b GDPR) or the legitimate interest of the controller to whom you have addressed yourself (6.1 lit. f GDPR), depending on the specific nature of the complaint;
  • when you submit a CV or your intention to participate in an internship program: carrying out pre-contractual steps at the request of the applicant/potential applicant (6.1 lit. b GDPR) in order to respond to the request;
  • when you submit a request for quotation: carrying out pre-contractual steps to respond to your request for quotation (6.1 lit. b GDPR);
  • when you visit the website for information purposes - our legitimate interest (6.1 lit. b GDPR);
  • when we use the Data for audit, internal control or to defend our interests and rights in legal proceedings - our legitimate interest (6.1 lit. b GDPR).

d) Recipients of the collected data

The data collected through the contact form or through the Careers section are intended for the internal departments of the Operator to whom you addressed your request. Depending on the case, these may be: Marketing Department, Human Resources Department, etc.

Other categories of recipients of the Data are:

  • our contractual partners located in Europe (authorized persons or operators). The data may be transferred or made accessible to our service providers and their subcontractors when they play a role in the technical and/or operational implementation of the Website or help us fulfill our processing purposes. This category includes: the Website hosting service provider and IT service providers who perform technical maintenance services for the Website, lawyers or external collaborators, external auditors.
  • state authorities/institutions when they address requests to us in accordance with their legal powers. The data may be transmitted upon request to the competent authorities and, in particular, to public bodies exclusively for the fulfillment of legal obligations, law enforcement officials, ministry officials, and organizations responsible for debt recovery, as well as in connection with the prosecution of perpetrators of crimes committed online.
  • social networks. Users can share pages that concern them on social networks by clicking on the share buttons. Data collection through social network share buttons is subject to the privacy policies of these third parties. 4. Exercising User Rights

In accordance with the GDPR, all Users who are natural persons have the following rights with regard to their personal data: a) access, b) rectification, c) deletion; d) withdrawal of consent, e) restriction, f) portability, g) objection, h) not to be subject to a decision based solely on automated processing; i) the right to lodge a complaint with the ANSPDCP.

Response time. We aim to respond to your requests as a priority, within the legal response time of 30 calendar days. If your request involves complex analysis or the collection of additional information, or if you have made several requests in a single message, we will respond within two months, with prior notification. 
Charges. We will not charge you for responding to your requests to exercise your rights. However, we reserve the right to charge a reasonable fee if your request is repetitive or excessive. 
Third party rights. Your rights are not absolute, therefore exercising them must not infringe on the rights of others (including ours or those of other operators). 

b) By contacting the National Supervisory Authority for Personal Data Processing (ANSPDCP), whose details can be found at: www.dataprotection.ro. If you consider that the response of the Data Protection Officer is not satisfactory, you may also lodge a complaint with the ANSPDCP. 
 

5. Data storage and archiving period 

User data will not be stored for longer than is strictly necessary for the purposes specified, in accordance with applicable laws. In this regard, Data collected to respond to requests for information and questions from Users is stored in an active database for the calendar year following receipt of the User's request, and then for 5 years. 

The data is stored in a temporary archive to enable Genesis Companies in Romania to defend themselves in any legal proceedings or for the purpose of prosecuting, recording, and investigating crimes, so that the Data can be made available to the judicial authorities. 

At the end of the temporary archiving period, the User's Data will be permanently deleted. 
In addition, the Operator may retain the Data permanently in anonymous form for statistical purposes. These studies will in no way make it possible to identify Users and will only refer to trends resulting from their aggregated Data. 


6. Safety 

 

The Operator will take appropriate technical and organizational measures to ensure that the Data is secure and to prevent unauthorized access or disclosure of the User Data. However, the Operator cannot guarantee that all risks of hacking, falsification, illegal reproduction or misuse of the Data have been eliminated. 

The database created when Users submit a request via the contact form is strictly confidential. 
Genesis companies in Romania undertake to take all necessary precautions and appropriate organizational and technical measures to protect the security, integrity, and confidentiality of the Data and, in particular, to prevent its distortion, deterioration, or access by unauthorized third parties. 

If we use subcontractors to provide our services, we assure you that we take the appropriate legal protection measures, technical and organizational measures to protect personal data in accordance with the relevant legal provisions.
 

7. Data transfer outside the European Union 

In the event of transfer of User Data to a third party located outside the European Union, Genesis Companies in Romania will ensure that the country to which the data is transferred provides adequate protection (the European Commission has made an adequacy decision regarding the recipient country). 

Otherwise, Genesis Companies in Romania undertake to restrict the transfer by appropriate legal means, and in particular by the standard contractual clauses of the European Commission. Users who wish to receive more information about how Genesis Companies in Romania protect their Data or obtain a copy of the legal instruments introduced may send a request to the email addresses mentioned in point 4 above.

 

8. Integration of third-party services and content

 

Based on Art. 6 para. 1 (f) of the GDPR (legitimate interest) and with the aim of making our company better known, we use social plugins on our website for the following social networks: Facebook, LinkedIn, Instagram, YouTube, Tik Tok. The commercial interest behind this is considered a legitimate interest within the meaning of the GDPR. Responsibility for data privacy-compliant operation must be ensured by the relevant provider.
